Terms of Service

1. Acceptance of terms

By accessing or using Starix Marketplace (“Starix”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.

2. Account registration

To use certain features you must create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for activity that occurs under your account.

3. Purchases & payments

• All purchases are subject to product availability and confirmation of payment.
• We use third-party payment providers (e.g. M-Pesa). Your payment information is processed by those providers and not stored by Starix except tokens necessary to process refunds.
• Prices and offers may change; confirmed orders reflect the price at checkout.

4. Shipping & delivery

Delivery times are estimates provided by logistics partners. Starix is not liable for delays caused by carriers, customs, or force majeure events. You will receive tracking details where applicable.

5. Returns & refunds

Our return policy governs returns and refunds. Eligible returns generally must be initiated within 7 days of delivery; damaged or incorrect items are eligible for full refund and free return. See our Return & Refund Policy for details.

6. User content & conduct

Users may post reviews and other content. You are responsible for your content and must not post illegal, infringing or abusive material. We may remove content that violates these Terms.

7. Intellectual property

All content on Starix (design, text, logos, images) is owned by or licensed to Starix, unless otherwise stated. You may not reuse our content without permission.

8. Prohibited activities

• Fraud, misuse of the platform, attempting to bypass fees, or interfering with service operation.
• Uploading malware or conducting phishing attacks.
• Impersonation of other users or Starix staff.

9. Termination

We may suspend or terminate accounts that violate these Terms or for other business reasons. Termination does not relieve you of obligations arising before termination.

10. Disclaimers & limitation of liability

To the maximum extent permitted by law, Starix provides services “as is” and disclaims warranties. Starix’s liability for any claim arising from use of the service is limited to the amount paid by you for the relevant transaction in the prior 12 months.

11. Indemnification

You agree to indemnify and hold Starix harmless from claims, liabilities, damages, and expenses arising from your breach of these Terms or your use of the service.

12. Governing law

These Terms are governed by the laws of Kenya, and you agree to the exclusive jurisdiction of the Kenyan courts for disputes (unless otherwise required by law).

13. Changes to terms

We may update these Terms. If changes are material, we will provide notice via the website or email. Continued use after changes indicates acceptance of the updated Terms.
